TERMS OF SERVICE
Effective October 24, 2026
The rules for using twobitcircus.com. Short version: look around, get in touch, don't scrape or copy our stuff, and remember that the real work happens under a signed agreement.
1. Agreement to These Terms
These Terms of Service ("Terms") are an agreement between you and 8Bit Circus Inc. ("Two Bit Circus," "we," "us," or "our") and govern your use of twobitcircus.com and any content, forms, and features on it (the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
2. What the Site Is For
The Site showcases our work and lets you contact us about events, custom builds, consulting, and press, and sign up for our newsletter. It is for informational purposes. Nothing on the Site is an offer or a binding quote.
3. Bookings and Services
Submitting an inquiry or booking request through the Site does not create a contract. Event bookings, fabrication, licensing, and consulting engagements are governed by a separate written agreement that spells out scope, pricing, deposits, cancellation, and liability. If that agreement conflicts with these Terms, the signed agreement controls for that engagement.
4. Acceptable Use
You agree not to:
- Use the Site in any way that violates applicable law.
- Submit false, misleading, or abusive content through our forms, or impersonate another person or organization.
- Scrape, crawl, or harvest content or contact information from the Site in bulk, other than ordinary search-engine indexing.
- Interfere with the Site’s operation, probe its security, or attempt to gain unauthorized access to any system connected to it.
- Use our newsletter signup to subscribe anyone other than yourself.
5. Intellectual Property
The Site and everything on it, including text, photos, video, 3D assets, logos, project names, and the design of the Site itself, are owned by 8Bit Circus Inc. or used with permission and are protected by copyright, trademark, and other laws. "Two Bit Circus," "Button Box Battle," "STEAM Carnival," and related names and logos are our trademarks.
You may view and share links to the Site for personal and non-commercial purposes. You may not copy, reproduce, modify, distribute, or create derivative works from Site content, or use our names or marks, without our prior written permission. Press may use materials from our Press page in editorial coverage of Two Bit Circus.
Some of our projects, such as OpenCade, are released under their own open-source licenses on their own sites. Those licenses govern those projects, not these Terms.
6. Content You Send Us
If you send us ideas, feedback, photos, or other material through the Site or by email, you give us a non-exclusive, royalty-free license to use it to respond to you and to operate and improve our business. We are not obligated to keep unsolicited ideas confidential, and we may already be working on something similar.
7. Third-Party Links
The Site links to third-party websites and services, including social media and sites for individual projects. We do not control them and are not responsible for their content, policies, or practices. Use them at your own discretion.
8. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete or current. Project descriptions, awards, and press references are presented in good faith but may become out of date.
9. Limitation of Liability
To the fullest extent permitted by law, 8Bit Circus Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of your use of the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, so they may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless 8Bit Circus Inc. from any claims, damages, and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms or your misuse of the Site.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Before filing a claim, we both agree to try to resolve the issue informally by email for at least 30 days.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Continued use of the Site after a change means you accept the updated Terms.
13. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site.
